Terms and conditions
The online sales website www.ruchemonnier.com (hereinafter referred to as the "Site") and the products (hereinafter referred to as "Products") which are offered there under the trade name La Ruche Monnier are published by the La Ruche Monnier recognized joint agricultural grouping registered in the Siret directory 840 618 235 00013 whose head office is La Bartasse 34800 Lieuran Cabrières FRANCE. All contact will be made by email to firstname.lastname@example.org.
I General provisions relating to general conditions of sale
These general conditions of sale (hereinafter "general conditions of sale" or "GTC") define the rights and obligations of the parties for the online sale of products offered by La Ruche Monnier on the ruchemonnier.com website.
La Ruche Monnier reserves the right to modify and develop these present GTCS at any time and without notice. The opposable GTC are those in force at the time of the conclusion of the sale on the website.
The general conditions of sale and legal notices in force on the site are opposable to the users of the site without reservation of place of residence.
The T & Cs are written exclusively in French and can be viewed directly on the site by users.
The confirmation of the order by the user of the site constitutes full acceptance of the GTC in force on the day of the order. The user expressly acknowledges having read these GTC, having understood and accepted them without reservation before confirming his order.
Failure by the Customer to comply with the obligations subscribed to under these General Terms and Conditions of Sale, and in particular in the event of fraud or any attempted fraud, and any incident of payment of the price of an order, may result in the suspension access to the Site, or even the termination of their Account depending on the degree of seriousness of the actions in question, without prejudice to any damages that may be claimed by La Ruche Monnier. Consequently, La Ruche Monnier reserves the right to refuse any Order with which there is such a dispute.
II Products available for sale
The purpose of the site is the online sale of honey and derived products, produced or selected by La Ruche Monnier.
The products offered on the site are the subject of a product sheet describing as accurately as possible the essential characteristics of the product, these elements being non-contractual. La Ruche Monnier reserves the right to modify and develop the content of the products available for sale and the related product sheets.
The products are available for sale within the limits of available stocks dedicated to the website. La Ruche Monnier reserves the right to withdraw all or part of the products offered on the site.
In the event of unavailability of one or more products after placing the order, the Customer will be notified by e-mail. An amicable solution must be obtained as much as possible with the Customer concerned. The amount of the order will be recalculated and a refund of the difference will be made to the customer or the order will be postponed until the availability of the product according to the agreement found. If the replacement product has a higher price, the supplement is payable.
La Ruche Monnier cannot be held responsible for any degradation of the products once they have been handed over to the carrier. The Customer of the site is solely responsible for the proper conservation and use of products purchased on the site upon receipt. La Ruche Monnier cannot be held responsible for any allergies resulting from the use or consumption of products sold on the site.
III Prices of products available for sale
The prices displayed on the product sheets are in Euros, all taxes included (TTC) excluding shipping costs except for exceptions specified on the product page. The prices displayed excluding taxes (HT) relate in particular to swarms and beehives.
The cost of the shipping costs of the order is calculated and indicated before the final validation of the latter. The cost of shipping charges are calculated based on the amount of products purchased, weight and volume of the latter. Shipping costs are added to the cost of purchases of products available for sale for a global payment of the order.
The customer will be able to access the details of the prices and costs of his order via the order form. Invoicing of products and shipping costs is done at the rate in effect on the day of the order.
La Ruche Monnier reserves the right to change the price of products available for sale online at any time and without notice.
I V Commands
Order taking is reserved for individuals of full age in full capacity to enter into a contract.
The sale of products offered on the site can only be fully realized through the order form.
The minimum order amount on the site is set at 20 euros excluding delivery costs. Any order below this amount will be canceled and refunded.
The order taking requires the transmission from the user of personal information that the latter confirms as being real and exact, belonging to him or to be authorized, on the day of the creation of the order. Any changes to this information must be sent to La Ruche Monnier before placing any order. The Customer can consult the confidentiality policy applied to the site via the following address: https://www.ruchemonnier.com/politique-de-confidentialite
To place an order on the ruchemonnier.com site, the Customer must select the products and quantities he wishes to purchase and add them to his Basket by clicking on the button dedicated to this action. Any modification of the Basket is possible as long as the Order has not been completed and validated on the site. The Customer undertakes to check the content of his Basket and to modify it if necessary before finalizing and placing his Order. La Ruche Monnier cannot be held responsible for any product or quantity error in the Customer's Basket.
The Customer then selects the delivery method that suits him, the price of the latter being added to the total cost of his Order. The Customer is required to verify that the chosen delivery method is suitable for its location.
To continue placing his Order, the Customer must click on the Order button and fully and unreservedly accept the General Conditions of Sale.
Clicking on the “Order” button constitutes a signature and the Contract is then formed between the Customer and La Ruche Monnier.
The Order is final and validated once full payment has been made on the website. The right of withdrawal provided for by law is applicable on the date of validation of the Order.
The Order is confirmed to the Customer by e-mail to the address provided by the latter in his Customer Account. The Customer undertakes to verify that the e-mail address provided is correct and valid. Any error of information transmitted by the Customer and resulting in the delay of the delivery of the Order, cannot be opposable to La Ruche Monnier.
Shipping and delivery information to the delivery provider is also done by email.
An invoice can be provided to the Customer on request by e-mail to email@example.com specifying the Order number.
La Ruche Monnier reserves the right to refuse any Order from Customer who does not comply with the GTCS, if sums are due on previous orders, or for any other legitimate reason and in particular in cases where the volumes ordered are abnormally high or unusual. for a Client.
V Payment of the Order
Payment for the Order is made in euros by bank payment card, checks or cash depending on the delivery methods. Checks should be made payable to "La Ruche Monnier". The accepted cards are: Visa, Mastercard and CB.
As part of a shipment via a delivery service provider, shipment can only take place upon receipt of full payment.
The Customer guarantees to be fully authorized and authorized to use the means of payment for the payment of his Order.
He also guarantees that he has the necessary and sufficient funds to cover the costs and expenses resulting from his order on the Site. La Ruche Monnier cannot be held responsible for any fraudulent use of the means of payment used.
When paying by credit card, payment for purchases is made using a secure procedure (SSL) offered by the Stripe service provider, so that no information transmitted by the Customer is intercepted by third parties. It is up to the Customer to save and print his payment certificate if he wishes to keep the bank details relating to his transaction.
Payment is made directly on the secure servers of the Operator's online payment solution, the Customer's bank details do not pass through the Site. The bank details provided during payment are protected by an SSL (Secure Socket Layer) encryption process. In this way, these details are not accessible to third parties.
In the event of non-payment of all the costs of the Order or of a payment incident, La Ruche Monnier will suspend the shipment of the products and cancel the order regardless of the level of execution. It also reserves the right to lodge a complaint with the competent courts if necessary (see XIV).
VI Terms and delivery of the Order
The delivery methods depend on the location of the Customer. Not all countries are served by La Ruche Monnier. It is important for the Customer to check the availability of his service.
La Ruche Monnier undertakes to ship the Products within a maximum of 15 working days after receipt of the order validated by payment.
In the event of partial delivery, La Ruche Monnier will contact the Customer by email specifying the products shipped in a second step and the estimated delivery time.
The delivery times mentioned according to the chosen shipping method are strictly informative and are not contractual. They take into account the preparation and shipping time by the carrier without La Ruche Monnier being responsible or liable for any delay in relation to the time announced on the site.
In the context of order withdrawals in "drive" mode, the order is to be collected by default on the date closest to the order, unless the order is taken less than 24 hours before said date.
In the context of home deliveries operated by La Ruche Monnier, it should be noted that areas not accessible by a vehicle are not served, for example, but not exhaustively: pedestrian area, restricted access area, area reserved for residents, ...
The Order and the related Products are delivered to the address indicated by the Customer when ordering and according to the delivery method selected on the site. The Customer undertakes to verify the address indicated, if the latter results in a delay or an incorrect delivery, La Ruche Monnier cannot be held responsible.
The times are dependent on the conditions at the time of the order and delivery. La Ruche Monnier cannot be held responsible if the service provider does not respect the announced deadlines. In the event of exceptional circumstances beyond our control, these conditions and the announced deadlines may be modified within reason.
Upon delivery of the Order, the Customer will then take full possession of the product (s) ordered. Each delivery is deemed to have been made upon taking possession of the Products by the Customer, proof of proper delivery is made by the means of control of the carriers.
Upon receipt of his Order, it is the Customer's responsibility to check the condition of the Package (sealed and undamaged) and that the products delivered comply with his order. In the event of a damaged package, the Customer is required to stipulate this by making reservations on the delivery slip and taking photos of the package in order to justify his disagreement, it is up to him to refuse it. Without this mention of complaint on the delivery slip, La Ruche Monnier will not be able to respond to a complaint relating to the quantity or condition of the products received.
If the Customer is absent when the package is delivered to the address mentioned, the carrier will offer another delivery window. The Customer must then follow the parcel withdrawal procedures without these conditions being enforceable against La Ruche Monnier. In the context of deliveries made directly by La Ruche Monnier, the customer will have two possible delivery slots. Beyond these two slots, the order will be considered null and void.
The signature of a receipt with presentation of proof of identity may be requested from the Customer.
If the parcel is returned to La Ruche Monnier, it may be reshipped at the Customer's expense only once. Beyond the second delivery which could not be completed because of the Customer, La Ruche Monnier will keep the products without any possible refund to the Customer, delivery costs included.
VII Condition of sales of swarms and queens
Swarms of bees and queen bees purchased on ruchemonnier.com can only be made available to French customers and withdrawn from the head office or for delivery by prior agreement.
VII - A Crossbreeding and crossbreeding
The original strains of La Ruche Monnier belong to the so-called Buckfast strain. The descendants were ensured by crosses and natural crossbreeding, La Ruche Monnier cannot therefore guarantee the purity of fertilization.
VII - B Payment
When ordering swarms, the Customer pays 30 € when ordering or 5 € for the order of a queen. The balance of the order will be paid on the day it is made available. In the case of payment by bank transfer, this must appear at value on the day it is made available.
La Ruche Monnier reminds that a deposit corresponds to a firm order commitment and that this is definitively lost for the Customer who withdraws outside the legal deadline.
VII - C Provision of swarms and queens
From the confirmation phase of the queens and swarms produced, the Customer is informed by e-mail of 2 or 3 possible dates for the removal of the swarms and queens which is done by appointment only.
Swarms or queens made available to the Client travel at the sole risk and peril of the client as soon as the latter leaves the place of production.
The Customer certifies and acknowledges being able and capable of providing the best care for bees, in particular in terms of transport, feeding and treatment.
Removal of swarms and queens should be done in a sufficiently ventilated, ventilated vehicle at a controlled temperature.
The Customer is solely responsible for loading the swarms and queens even if he receives assistance from a member of La Ruche Monnier for loading.
VII - D Delay in making swarms available
As swarms and queens are produced by natural means in beekeeping, La Ruche Monnier cannot be held responsible for any delay in delivery linked in particular to weather conditions or natural events preventing or delaying the provision.
The Customer can at any time get information from La Ruche Monnier by e-mail at the address firstname.lastname@example.org to request the evolution of the situation of his order of swarms or queen from the start of production or during this if conditions change.
The dates of availability are provisional dates. These dates do not become final until the validation of the conformity of the queen's laying. It is then sent to the Customer, an e-mail telling him from when he can take possession of his swarms or queens.
VII - E Impossibility of the customer during the collection on the scheduled day
In the event that the customer has not come to collect his swarms or queens within the agreed timeframe, he has 15 additional days to agree on a recovery date. Beyond these additional 15 days, the customer will be considered to have withdrawn from the order and his deposit will be permanently lost.
VII - F Transfer of ownership
The Client becomes the sole owner of his swarms and queens at the very moment they were handed over to him by La Ruche Monnier. As such, the Customer becomes responsible for everything that results from this transfer of ownership. The Customer assumes full responsibility for the loading as well as the transport of the bees and confirms that he is in order on this subject both with regard to the law and to health measures related to the transport of live animals.
VII - D Request for postponement of production of swarms
The Customer may request to postpone the delivery of his order until 15 days after the date initially agreed. Beyond these additional 15 days, the customer will be considered to have withdrawn from the order and his deposit will be permanently lost.
VIII Product return
La Ruche Monnier accepts the return of products at their expense only if they are defective and they are held liable for the defect of the product (s).
The product sheets being as descriptive as possible, any return of parcel concerning a Product which does not correspond to the representation of the Customer will not be paid by La Ruche Monnier.
The Customer has 48 hours after receipt of the package to inform La Ruche Monnier of a defective or damaged product.
The Customer will contact La Ruche Monnier by email at email@example.com mentioning the nature of the defect, the order number, the name of the customer and his address.
The Customer will ship, within 10 days maximum, at La Ruche Monnier's expense, the Product (s) concerned intact by post only in Tracked Parcels to the following address: La Ruche Monnier, La Bartasse, 34800 Lieuran Cabrières FRANCE. The returned Product (s) must be properly packaged and protected with their original packaging intact. A single return will be accepted and paid for by La Ruche Monnier and any other means of return than by post will be accepted.
Upon receipt of the defective Products and after recognition and validation of the defective condition of the product (s) by La Ruche Monnier, a replacement by a new product will be offered. In case of out of stock, a refund will be made to the Customer within 10 days of receipt of the defective product (s). No commercial gesture or additional compensation can be claimed from La Ruche Monnier.
IX Right of withdrawal
In accordance with article L. 121-20 of the Consumer Code, the Customer has a period of 14 clear days to exercise his right of withdrawal from the date of receipt of his order or the order taking in in the case of a swarm order, to return, at its own expense, the products ordered intact for reimbursement.
The Customer will exercise his right of withdrawal by informing La Ruche Monnier by email to firstname.lastname@example.org.
The Products will then be returned only by post in a tracked package to the address of the head office. The Products must be in perfect condition for resale, unopened, used or damaged. The Customer has a period of 5 days from their notification to make use of their right of withdrawal to return the Products. He must ensure that his request has been properly received.
La Ruche Monnier will refund the order within 14 days from the date of receipt of the Products, excluding shipping costs by bank transfer to the Customer. The Customer will ensure to transmit all the elements necessary for his identification facilitating the implementation of the reimbursement.
X Exclusion of the right of withdrawal
In accordance with article L 221-28 of the Consumer Code, the Customer cannot exercise his right of withdrawal, in particular in the following cases:
- Products which cannot be returned for reasons of hygiene or health protection, if they have been unsealed or if, after having been delivered, they have been inseparably mixed with other articles ;
- Delivery of products that have been made to the Customer's specifications or clearly personalized;
- Products likely to deteriorate or expire quickly.
XI retention of title
The Products sold remain the full and entire property of La Ruche Monnier until full receipt of the price, in principal, tax costs, compulsory contribution included.
XII Customer Service
La Ruche Monnier customer service can be contacted by email at email@example.com. The Customer's request must be as precise as possible in French and in clearly understandable language, so that a response can be sent to him as soon as possible as far as is reasonable.
XIII Responsibility and commitment
La Ruche Monnier undertakes to deliver to their Customer products that comply with the descriptive product sheets without, however, the latter being contractual. Honey being a living material, its appearance can vary without its taste quality and its properties being altered.
La Ruche Monnier cannot be held responsible for any direct or indirect damage, foreseeable or not, bodily, material or immaterial caused to the Customer or to a third party resulting from the correct or non-compliant use of the Products available for sale. Their use is done under the sole responsibility of the Customer.
The Customer is fully aware that like any food, honey can be an allergen and that it is the Customer's sole responsibility to ensure that its consumption is safe for himself or for a third party. La Ruche Monnier cannot be held responsible for any allergies arising from the consumption of their products.
In case of doubt about the composition of the product, it is up to the customer to make a request to obtain the necessary information from La Ruche Monnier, before placing any order.
If, however, the assumption of liability of La Ruche Monnier should be established and retained due to damage suffered by the Customer and attributable exclusively to the placing of an Order (excluding the use of the Products), the liability will be limited to the amount of the order paid by the Customer on the site.
The Customer or user of the Site has a period of 1 month to make a complaint to La Ruche Monnier by e-mail to the address firstname.lastname@example.org from the occurrence of the event constituting the complaint.
In the event of difficulties in the application of these General Conditions of Sale, the parties will seek an amicable solution before any legal action. However, in the event of a persistent disagreement, the Customer has the possibility, in accordance with the Consumer Code, of calling free of charge to a consumer mediator specially appointed for this purpose.
In the event of a dispute and if the amicable attempts were unsuccessful, these GTC and the operations resulting therefrom are subject to French law and to the competent courts (Tribunal de commerce de Montpellier).
